Included-

  • Full charter of the vessel with all its supporting tools, equipment, and crew

  • Pick up/ transfers from/to Airport/Hotel

  • Park fees, Fuel surcharges and boat permits and clearance

  • Use of tender boat/skiffs.

  • All available working water-sport equipment and toys onboard can be use and utilized by the guests within the permitted area/ zone.

  • Diving, snorkelling and the usage of the related equipment, Air and Nitrox fills (1 dive instructor and 1 dive master)

  • All meals, snacks, beverages, and complimentary house wines onboard upon availability

  • 1 Gb of Satellite Internet Wi-Fi

  • 20 minutes of Spa treatments

Excluded-

  • 8% Government tax and Insurance

  • Crew Gratuities, subject entirely to the guest’s discretion (customary gratuity is 10% of the trip charter rates)

  • Any costs that may arise due to situations beyond our control, including but not limited to the flight cancellation or delays

  • Additional alcoholic drinks

  • Additional Spa treatments

  • Additional Satellite Internet Wi-Fi

Rates & Reservations

Kailana Premier rates are quoted in USD and can be paid in the equivalent in any major currency on the time the payment made. Please contact us at cruise@kailanapremier.com for current charter rates and available offers.

All enquiry for reservation/ booking for Kailana Premier, must be made in written by email to the designated addresses. Bookings/reservation will only be confirmed upon receiving deposit. Deposit must be made within 7 days of the Invoice sent. When guests secure the booking with deposit, they acknowledge that they fully understand and accept all terms and conditions of Kailana Premier.

Full Boat Charter Booking

15% Deposit                          Upon confirmation > 360 days from trip departure date

50% Final balance                120 – 91 days before departure

100% Full Payment              For booking made 90 days before departure date

Payment of the deposit will stand as a general acceptance of terms and conditions by the client.
Payment must be received in full amount as stated in the invoice. Bank charges must be carried by the client.

Cancellation and Alterations

All cancellation must be made official in written via email (or postal mail). The cancellation will take effect upon received by Kaialna Premier official. Cancellation sent through postal mail will be recognized if the charterer is able to present proof of delivery (I.e., postal tracking/registered mail) upon request.

Cancellation made by the Charterer

360 – 181 days before trip departure date will incur 15% of the total charter cost as cancellation fee
180 – 100 days before trip departure date will incur 30% of the total charter cost as cancellation fee
99 – 31 days before trip departure date will incur 70% of the total charter cost as cancellation fee
30 days before trip departure date will incur 100% cancellation fee

Should the Charterer fail to pay, after having been given written notice by Kailana Premier, any amount due, Kailana Premier reserves the right to assume the booking have been repudiated by the Charterer and to retain the full amount of all payments made and to recover all sums unpaid and due up to the date of the repudiation.

Cancellation By Kailana Premier

a) If by reason of force majeure Kailana Premier fails to deliver the Vessel within forty-eight (48) hours, the Charter Period shall be extended by a time equivalent to the delay or postponed to a mutually agreed time.

b) If the cancellation is for any reason, other than force majeure, the charterer shall be entitled to immediate repayment without interest of the full amount of all payments made by him under the terms agreed and shall in addition be entitled to be reimbursed for his travel expenses.

c) Special Covid-19 Policy: The Parties hereby agree that should an official governmental restriction, be issued prior to the embarkation date either in the charter destination or to/from the Charterer’s state and country of residence, preventing the client from being able to embark on Kailana Premier, the charter will be postponed and rescheduled within 12 months or more if travel ban is extended.

Kailana Premier Policies

Child policy.
Any underage child will be under the full responsibility of the parents or guardian.

Jet-skis policy
Children below the age of 16 years old will not be allowed to drive on their own. They will need to ride with a crew member or an adult guest having sufficient skill. No driving will be allowed under the influence of alcohol. Restrictions may apply according to the areas. Guests are required to always follow the crew’s instructions in order to avoid incidents with jetskis. In case of damages, a repair fee will apply and should be paid before the departure of the guests.

Smoking policy
Smoking is strictly prohibited inside all interior areas of the yacht. Guests are authorized to smoke outside in designated areas.

Captain's authority.
For any situations related to safety, the guests will have to comply with the captain instructions.

Force Majeure.
In this Agreement ‘force majeure’ means any cause directly attributable to acts, events, non- happenings, omissions, accidents or Acts of God beyond the reasonable control of Kailana Premier, her crew, or the charterer (including, but not limited to, strikes, lock-outs or other labour disputes, civil commotion, riots, acts of terrorism, blockade, invasion, war, fire, explosion, sabotage, storm, collision, grounding, fog, governmental act or regulation, contaminated fuel, major mechanical or electrical breakdown beyond the crew’s control and not caused by lack of maintenance and/or Kailana Premier’s or crew’s negligence). crew changes and shipyard delays not attributable to the forementioned causes, do not constitute force majeure.

The itinerary or schedule might change due to weather or any other situations beyond our control.

Break down
In case of breakdown impairing the cruise for more than 24 hours, prorate reimbursement will be paid within two working days or if mutually agreed, allow a pro rata extension of the Charter Period.

Insurance

The Owner shall insure Kailana Premier with recognised terms extended to provide Permission to Charter and to cover Third Party liability, Water Skiers liabilities together with liabilities arising from the use by the Charterer and other competent person(s) authorised by him of personal watercraft, including jet skis, wave runners and other similar powered craft as well as windsurfers, dinghies, catamarans or other water-sports equipment carried by the Vessel. The insurance shall also cover Pollution
and include insurance of Crew against injuries and/or Third-Party liabilities incurred during
the course of their employment. The Charterer shall remain liable for any loss, damage or liabilities arising from any act of negligence of the Charterer or his Guests and not recoverable by the Owner under his insurance.

Copies of all relevant insurance documentation shall be available on request for inspection by the Charterer prior to the Charter on reasonable notice to Kailana Premier and shall be carried on board the Vessel.

The Charterer should carry independent insurance for Personal Effects whilst on board or ashore and for any Medical or Accident expenses (including emergency transport evacuation) incurred.

The Charterer should be aware that neither Charterer’s Liability Insurance nor Cancellation and Curtailment Insurance are included in this terms and condition

Liability

Kailana Premier will not be held responsible in case of any injury or illness that happens during the period of the cruise. Kailana Premier will not be held responsible in case of lost or breakage for any of the guest personal properties.

In case of loss or damages of any of the company properties (Jetskis, carpet, etc.), replacement or repair fee will apply and should be paid before the departure of the guests.

Arbitration

This terms and condition serve as an agreement/contract between Kailana Premier and The charterer and shall be governed and constructed in accordance with the law of the republic of Indonesia and both parties agree to submit to the exclusive jurisdiction of the courts of the Republic of Indonesia.

 

Definitions:

G.I.T stands for Group Inclusive Tour, where a traveler joins other tourists for a Group Inclusive Tour and don’t have to worry about your accommodation, transportation, and other parts of your trip. A group of a minimum of 10 people travels together. These people can be related or non-related and usually book on the same travel arrangements. The group size is not defined by the number of travelers but by the size of accommodation reserved.

Agent refers to a person, company, partnership, company or other legal entity who makes a reservation on behalf another person or group. An agent may have a dual capacity when making a Dive Package reservation for himself/herself & another person or group of persons.

Unavoidable circumstances are event(s), including but not limited to weather conditions, unforeseen natural phenomena, Force Majeure (natural disasters, epidemics, and unforeseen acts of God etc.) and unavoidable acts of man (war, riots etc.).

FAM Cruise  or Familiarization cruise is available to agencies and is subject to availability and the full discretion of Kailana Premier, restricted to one person per agency. FAM trips will include all standard inclusions only indicated in the itinerary. Some fees may apply.
